Dodd-Franks and the Return of the Lease Purchase Transaction
Short sales rule the real estate market. Some talk of statistics showing a real estate recovery, while others say the Federal Reserve’s actions ensure a second collapse. Framed by this uncertainty, the real estate market is now filed with prospective buyers who despite having recently gone through foreclosure, short sales, bankruptcies and other credit damaging events, want to buy a home.

Will Modifications Replace Short Sales?
Many of my clients are approaching me asking if they should modify or short sale. A year ago I would have said modifications are an urban legend. However, in 2013, the word “modification” may actually have some meaning.

Tax Liens as an Investment
You may have heard about investing in property tax liens. What are they? How do you buy them? What do you get for your money? As we all know, virtually all property in this state not owned by a government or charity is subject to a property tax. However, many people fail to pay their property taxes timely. When those property taxes are not paid, the County, in order to raise the funds necessary to provide service, sells liens to investors.

Be One of "The Few"
Every year starts off with a feeling of hope; a fresh start if you will, with a positive outlook of new ideas and goals. This is the time of year when we close the book on the past year and excitedly anticipate what is in store for us around the corner in the New Year. This time of year always puts a bit of a skip in my step and I’m guessing I’m not alone.

What Scares You?
As October arrives I look forward to cooler weather and Halloween. I have always enjoyed the lighter side of Halloween, children in costumes, popcorn balls, Monster Mash music, etc. I have never enjoyed the scary side.

May the Flame ...
I am writing this article on August 12th, 2012 while watching the closing ceremonies of the Summer Olympics. However, by the time you are reading this, the Olympic Flame of the 2012 London Summer Olympics will have long been extinguished. Safe to say that many of us took some time or a lot of time to tune-in this past summer to view this planet’s finest spectacle in sports.

Supreme Court is Reviewing the Case of M&I Marshall & Ilsley Bank V. Mueller
Recently we wrote an article about the March 20, 2012 decision by the Arizona Court of Appeals, Division One in the case of Helvetica Servicing, Inc., a California corporation fna CRM Venture Law, Inc. dba The Helvetica Group v. Michael S. Pasquan, 1 CA-CV 10-0418. That case held that a construction loan that refinances a purchase money loan qualifies for anti-deficiency protections if (1) the deed of trust securing the loan covers the land the dwelling constructed thereon; and (2) the loan proceeds were in fact used to construct a residence that meets the size and use requirements set forth in A.R.S. § 33-729(A).

Impact Upon Values of Today's More Lengthy Foreclosure Process
The rise and fall of foreclosure rates has become a barometer for the health of our housing market. Among other foreclosure measurements experienced over recent years has been the correlation between higher foreclosure rates and the decline in value of not only the property in foreclosure but also of other homes in the immediate area, including homes that were never the subject of a loan default or foreclosure.

Arizona votes passed the Arizona Medical Marijuana Act (“MMA”) in November 2010. The MMA legalized under Arizona law the use of marijuana for limited medical purposes. The passage of the MMA occurred during the collapse of the Arizona real estate market and the associated vacancies in commercial real estate.

Gaining Experience
I have always considered myself blessed to have started my career with the best possible training. Additionally, I had access to many great industry leaders who mentored me as I grew into the profession.
